Detroit police to consider use of force changes, including ban on chokeholds - Detroit Free Press

General bans on chokeholds and shooting from or at a moving car are among the items that the Detroit Police Department will consider as the department and the Detroit Board of Police Commissioners continue to review the use of force policy.

The department announced Monday the changes to its use of force policy it will consider implementing. The changes come from a list of recommendations the commissioners proposed in June.

DPD will consider the following additions to its use of force policy:

  • A general ban on chokeholds and a strict prohibition of trainings of any banned holds
  • A general ban on shooting from a moving car and shooting at a moving car as this is rarely necessary and the responsibility of resolving instances of assumed non-compliance rests on the DPD officer
  • Consideration for "special populations" as a potential influence on an officer's decision to increase or reduce the amount of force used. In the board's recommendation, special populations include pregnant women, children, elderly people, people with physical and mental disabilities and people with limited English proficiency.
  • A separate section on de-escalation and on duty to intervene
  • Encouraging officers to consider requesting a supervisor for assistance before escalating to force that goes beyond an officer's presence and verbal direction

"(The department) accepted majority of the key changes I recommended. I was very pleased, especially with the general prohibition of chokeholds; I expected that to be harder but I appreciate that they saw the importance of implementing these changes," said police commissioner Evette Griffie of District 2. "I'm looking forward to the actual document, to look at it very closely to make sure it will be used as intended." The board needs to make sure the training is implemented and matches the policy.

Once DPD finalizes its list of recommended changes, the policy will then be submitted to the board for its approval or any needed revisions. If approved, the policy is then posted online for the public's review for 30 days.

"I think the public will respond favorably as it's in their best interest," Griffie said. "It makes officers take more steps before using force."

These initiatives will also make Detroit a national leader in police reform as many departments nationwide look to implement similar measures, she said.

"Detroit will be a model city if these policy changes are made," Griffie said. "It will become a point of pride for the city and its residents."

The department's list of recommended changes comes as the third fatal shooting involving police in recent weeks was reported Thursday. The incident resulted in the death of a man on the city's west side after he chased officers with a sword and threw a dagger.

"This issue is no doubt timely," said Board Chair Willie Bell. "Chief Craig has been supportive and we have come a long way in tackling these issues in the last decade. The update is right on target. The bottom line is we want to make sure there is accountability."

DPD did not respond to a Free Press request for comment Monday evening.

Despite the board's recommendation to begin collecting use of force data for analysis and monitoring, DPD stated this will not be added as the department does not have a process to properly report the data while protecting the information. Detroit police currently reports use of force incidents into the FBI's database.

Other recommendations from the board of commissioners include the addition of scenario-based training in uses of force and a requirement to report when drawing a firearm and acquiring a target.

The police department is still reviewing the board's recommendations and the policy is subject to change. Griffie said she expects the finalized policy will not be much longer and anticipates its completion by next week.

The Detroit Board of Police Commissioners will meet via Zoom on Thursday at 3 p.m.
